2. TERMS OF SALE & FULFILLMENT

By placing an order with 2RICH GAMES LLC, you represent that you are at least the age of majority in your state or province of residence and are legally capable of entering into binding contracts.

Orders & Payment: You acknowledge that you are purchasing a physical product. Your payment method will be authorized and charged immediately upon checkout. We reserve the right to refuse or cancel any order placed with us for any reason, including limitations on quantities available for purchase, inaccuracies in product or pricing information, or suspected fraud.

Estimated Shipping & Delays: Orders are estimated to ship according to the timeline posted on our main checkout page or order confirmation. If nothing is posted, then order timeline defaults to 3-30 days from processing to delivery. While we make every reasonable effort to meet estimated ship dates, ship dates are estimates only and are not guaranteed. Delays in manufacturing, global freight, customs processing, carrier interruptions, or force majeure events may occur. 2RICH GAMES LLC is not liable for any direct, indirect, or consequential damages resulting from shipping delays.

3. REFUND, CANCELLATION & RETURN POLICY

We want you to be completely satisfied with your purchase. Because manufacturing, freight, and fulfillment involve substantial up-front costs, the following terms govern all sales:

Order Cancellations: You may cancel an order for a full refund at any time before your item enters the fulfillment or shipping phase. Once an order has been assigned a tracking number or processed by our fulfillment center, it cannot be canceled and must be handled under the return process below. To request a cancellation, contact [email protected].

Damaged, Missing, or Defective Items: If your game arrives damaged, missing components, or defective, you must notify us within 14 calendar days of delivery at [email protected] with your order number, a detailed description, and clear photos of the damage/defect. Upon verification, we will ship replacement parts or a replacement unit at no additional cost to you.

Returns After Delivery: Unopened, factory-sealed, and undamaged game units may be returned within 30 calendar days of delivery. The customer is solely responsible for paying all return shipping costs and ensuring the product is packaged securely. Refunds (minus any non-refundable fees as outlined in Section 4) will be issued to the original payment method only after the returned item is received, inspected, and verified to be in new, resalable condition.

4. SHIPPING & HANDLING FEES

Shipping, handling, order processing fees, and order protection fees (including, but not limited to, our $1.99 Standard Insured Shipping / Priority Processing Fee) cover the immediate costs of fulfillment logistics and insurance coverage. Consequently, all shipping and handling fees are 100% non-refundable once an order has left our fulfillment facility or entered the shipping process.

5. TAXES

Applicable state and local sales taxes are calculated at checkout based on the shipping address provided and local tax regulations. Prices displayed on our store reflect applicable tax settings. The customer remains responsible for any local use taxes or duties not collected at checkout where applicable by law.

6. INTELLECTUAL PROPERTY & PROPRIETARY RIGHTS

All content, logos, branding, graphics, artwork, trade dress, text, instructions, game mechanics, board designs, card contents, and digital assets associated with the Capitalize Board Game and 2RICH GAMES LLC are the exclusive intellectual property of 2RICH GAMES LLC and are protected by United States and international copyright, trademark, and intellectual property laws. Unauthorized copying, duplication, modification, reverse-engineering, commercial resale, distribution, or creation of derivative works without express written consent from 2RICH GAMES LLC is strictly prohibited.

7. ENTERTAINMENT PURPOSES ONLY & NO FINANCIAL DISCLAIMER

CAPITALIZE BOARD GAME IS STRICTLY A FICTIONAL GAME CREATED FOR ENTERTAINMENT PURPOSES ONLY. You explicitly acknowledge and agree that playing, purchasing, or interacting with Capitalize Board Game, its themes, mechanics, strategies, or promotional materials will NOT guarantee, promise, predict, or lead to real-world financial success, wealth generation, or achieving "millionaire" status. Nothing contained within the game, packaging, website, marketing materials, or communications constitutes financial, investment, legal, tax, or business advice. 2RICH GAMES LLC makes no representations, warranties, or guarantees regarding real-world monetary outcomes. Any references to wealth, money, assets, investments, or becoming a millionaire are purely thematic game elements.

8. LIMITATION OF LIABILITY & DISCLAIMER OF WARRANTIES

IN NO EVENT SHALL 2RICH GAMES LLC, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, OR SUPPLIERS BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICE OR ANY PRODUCTS PROCURED USING THE SERVICE, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR PURCHASE OR USE OF THE PRODUCT. IN STATES OR JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW, AND IN NO EVENT SHALL EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO 2RICH GAMES LLC FOR THE INDIVIDUAL PRODUCT GIVING RISE TO THE CLAIM.

You agree to indemnify, defend, and hold harmless 2RICH GAMES LLC, its parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees from any claim, demand, liability, loss, or expense, including reasonable legal fees, made by any third party due to or arising out of your breach of these Terms, your misuse of the Product, or your violation of any law or the rights of a third party.

10. BINDING ARBITRATION AND CLASS ACTION WAIVER

PLEASE READ THIS SECTION CAREFULLY—IT AFFECTS YOUR LEGAL RIGHTS.

Mandatory Arbitration: You and 2RICH GAMES LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms, the purchase of the Product, or the breach, termination, enforcement, interpretation, or validity thereof, shall be determined solely by binding individual arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify. Arbitration shall be administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules.

Class Action Waiver: YOU AND 2RICH GAMES LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. Further, unless both you and 2RICH GAMES LLC agree otherwise in writing, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.
